An application form shall be created by the city and include the following required information and filing fee to be considered a completed and properly submitted application:
(A) An application for appeal shall be based on a claim of one of the following:
(1) The true intent of these codes or rules legally adopted thereunder have been incorrectly interpreted;
(2) The provisions of these codes do not apply; or
(3) An equally good or better form of construction is proposed.
(B) An application must state the code section the applicant is appealing, or some other legal or constitutional basis upon which the city’s decision or action is objectionable.
(C) A filing fee shall be required with an application. Fee shall be set by resolution. If the applicant successfully wins the appeal, said fee shall be reimbursed.
