No building shall be erected or enlarged unless the following yards are provided and maintained in connection with such building, structure or enlargement:
A. Front Yard: On every zoning lot a front yard of not less than twenty five feet (25') in depth shall be provided. However, where lots within the same block and comprising forty percent (40%) of the frontage on the same street are already developed with front yards with an average depth of less than twenty five feet (25'), then such average depth shall be the required front yard depth for such frontage in said block.
B. Side Yards:
1. On each lot upon which a dwelling is constructed there shall be a combined total of side yards of not less than fifteen feet (15') with a minimum side yard requirement of six feet (6'). Note: If rear yard is currently reduced to less than thirty feet (30'), confirm proposed structure will comply with subsection C of this section before approval of said proposed structure.
2. On corner lots, there shall be maintained a side yard on the street side of not less than ten feet (10'), and in the case of a reversed corner lot there shall be maintained a setback from the side street of not less than seventy five percent (75%) of the front yard required on the lots in the rear of such corner lot, but such setback need not exceed twenty five feet (25'). No accessory building on said reversed corner lot shall project beyond the front yard required on the adjacent lot to the rear, nor be located nearer than five feet (5') to the side lot line of said adjacent lot.
3. On lots upon which a permitted nonresidential use is erected or enlarged, there shall be a side yard of not less than ten feet (10') on each side of the main structure, and a combined total of side yards of not less than twenty feet (20').
C. Rear Yard: A rear yard of not less than thirty feet (30').
Exception: A rear yard setback may be reduced to fourteen feet (14') if:
1. Any of the following statements are true:
a. If the property has no access from public rights-of-way to the rear or side of the property. A side yard of ten feet (10') or more is considered access from the front street. Sheds ten feet (10') by twelve feet (12') and under are considered mobile structures and are not considered a barrier for access. Fences and trees, bushes and other growth are not considered a barrier for access.
b. The property already has a garage with a minimum of twenty feet (20') wide and a minimum of twenty feet (20') deep with a single sixteen foot (16') wide door or a minimum of two (2) 8-foot wide doors side by side serving separate stalls.
c. The property has space available for the proposed structure to the rear as well as a future garage twenty four feet (24') wide and deep accessible to the side with access from the street including setbacks for proposed structure and garage as required by this Code.
2. This exception is intended for decks, porches and covered patios built after construction of a new residence. This exception may not be used to reduce the rear yard setback for construction of the principal structure. (Ord. D-046, 11-21-2017)
