(A) In case, on application for such approval of any plat, the City Council shall fail to either approve or reject the same within 60 days from the date of application, the person proposing said plat shall have the right to file the same with the County Recorder, Assessor and Auditor.
(B) If said plat is disapproved by the Council, such disapproval shall point out wherein said proposed plat is objectionable.
(C) From the action of the Council refusing to approve any such plat, the applicant shall have the right to appeal to the District Court within 20 days after such rejection by filing written notice of appeal with the City Clerk.
(D) Such appeal shall be triable de novo as an equitable proceeding and accorded such preference in assignment as to assure its prompt disposition.
