§ 9-7-12 PERSONS WITH DISABILITIES PARKING.
   (A)   The following regulations shall apply to the establishment and use of persons with disabilities parking spaces:
      (1)   Establishment: Persons with disabilities parking spaces shall be established and designated in accordance with chapter 321L of the Code of Iowa and Iowa Administrative Code, 661.18.
      (2)   Signage: Each space shall be clearly and prominently designated as a space for persons with disabilities by displaying a painted international symbol of accessibility on the surface of the space if paved and displaying a persons with disabilities parking sign listing the amount of the penalty, provided that such signage designating each space is in accordance with chapter 321L of the Code of Iowa.
      (3)   City-Owned Properties And Streets: The City Manager and Police Chief shall designate persons with disabilities parking spaces for City-owned properties and streets. A listing of all such designated spaces shall be kept in the Office of the City Clerk.
      (4)   Downtown Business District: An area defined for purposes of this section, as follows: that area between the midline of Avenue H on the south side, the south edge of Avenue F on the north side, the midline of 6th Street on the east side, and the midline of 10th Street on the west side.
      (5)   Private Property: A business may set aside persons with disabilities parking spaces on the business property (see subsection 9-7-18(A)(2) of this section).
      (6)   Improper Use: The following uses of a persons with disabilities parking space, located on either public or private property, shall constitute improper use of a persons with disabilities parking permit, which is a violation of this Code:
         (a)   Use by an operator of a vehicle not displaying a persons with disabilities parking permit;
         (b)   Use by an operator of a vehicle displaying a persons with disabilities parking permit but not being used by a person issued a permit or being transported in accordance with section 321L.2(1b) of the Code of Iowa;
         (c)   Use by a vehicle in violation of the rules adopted under section 321L.8 of the Code of Iowa;
      (7)   Wheelchair Parking Cones: No person shall use or interfere with a wheelchair parking cone in violation of the following:
         (a)   A person issued a persons with disabilities parking permit must comply with the requirements of section 321L.2A(1) of the Code of Iowa when utilizing a wheelchair parking cone.
         (b)   A person shall not interfere with a wheelchair parking cone which is properly placed under the provisions of section 321L.2A(1) of the Code of Iowa.
