§ 7-2-33 SIDEWALKS; RIGHTS-OF-WAY; STREETS; ENCUMBERING.
   (A)   Except as provided in divisions (B), (C) and (E) below, no person shall obstruct or encumber any sidewalk, right-of-way or street with boxes, barrels, packages, signs, automobiles, trucks, vehicles, machinery, junk or any other goods, ware or merchandise of any kind.
   (B)   The right-of-way, sidewalk or street may be obstructed or encumbered temporarily when receiving or taking away items from adjoining premises, or when building or improving such property if such obstructing or encumbering is done after obtaining permission from the Public Works Director under such conditions as may reasonably be imposed.   
   (C)   Except for home occupations, cottage businesses and businesses adjacent to the right-of-way of Business Highway 61, 18th Street and 15th Street, commercial businesses may place signs or displays of goods for sale on the right-of-way; provided that, the following conditions are adhered to:
      (1)   Signs or displays of goods cannot be placed on the right-of-way until 7:00 a.m. and must be removed from the right-of-way by 6:00 p.m. the same day;
      (2)   Signs located on the sidewalk or right-of-way shall be no larger than 18 inches by 36 inches;
      (3)   No more than three signs will be permitted to be placed on the sidewalk or right-of-way by any one business;
      (4)   Signs and displays of goods can only be placed on the sidewalk or right-of-way adjacent to the business which they advertise or from which they are sold;
      (5)   Displays of goods on the sidewalk or right-of-way shall be no larger than three feet wide by three feet high by three feet long;
      (6)   No more than two displays of goods will be permitted to be placed on the sidewalk or right-of-way by any one business;
      (7)   Signs and displays of goods on the sidewalk or right-of-way may not be located closer than three feet to the back of the curb, nor closer than five feet to the side property line nor closer than ten feet from the side property line adjacent to the street of a corner property;
      (8)   Signs and displays of goods, if placed on the sidewalk or right-of-way, shall be located so that a straight pathway, 42 inches in width, extending across the property, and in line with sidewalks on adjoining properties will be kept clear and unencumbered.
   (D)   Except for home occupations, cottage businesses and business adjacent of the rights-of-way of Business Highway 61, 18th Street and 15th Street, commercial businesses may place goods for sale on the sidewalk and right-of-way adjacent to their business in conjunction with a sidewalk sale provided that the following conditions are adhered to:
      (1)   Displays of goods on the sidewalk or right-of-way cannot be placed on the sidewalk or right-of-way until 8:00 a.m. each day and must be removed by sunset each day;
      (2)   Displays of goods on the sidewalk or right-of-way may not be located closer than ten feet from the side property line adjacent to the street of a corner property;
      (3)   Displays of goods, if placed on the sidewalk or right-of-way, shall be located so that a straight pathway, 36 inches in width, extending across the property, and in line with sidewalks on adjoining properties will be kept clear and unencumbered; and
      (4)   Sidewalk sales are limited to no longer than one week in duration and to, nor more than, 12 in a calendar year.
   (E)   Except for commercial and industrial enterprises, the right-of-way may be obstructed or encumbered by Christmas decorations under the following restrictions.
      (1)   Christmas decorations may be placed upon the right-of-way commencing at 4:00 p.m. on Thanksgiving Day and removed by 4:00 p.m. on New Year’s Day.
      (2)   No individual item of Christmas decoration may exceed 40 inches in height or 60 inches in width.
      (3)   Christmas decorations may not be placed closer than three feet to an adjoining property line. Christmas decorations may not be placed closer than two feet to the traveled portion of the roadway or street.
      (4)   Christmas decorations that constitute a traffic hazard or obstruction to the vision or clear view of vehicular traffic may be prohibited by the Chief of Police.
      (5)   Christmas decorations that require an electrical cord across the sidewalk and/or right-of-way will be prohibited. Any person erecting Christmas decorations in the parking, that require electrical power, will maintain a liability policy in an amount as established by the City Council.
