When a person is convicted of a simple misdemeanor and a specific penalty is not provided for, the court shall determine the sentence, and shall fix the period of confinement or the amount of fine, if such be the sentence, within the following limits: for a simple misdemeanor, imprisonment not to exceed thirty (30) days; or a fine of at least sixty five dollars ($65.00), but not to exceed six hundred twenty five dollars ($625.00). In cases where citations for violations of this chapter are written by the citing official as municipal infractions rather than as simple misdemeanors, the penalties shall be as set forth in a schedule approved by resolution of the City Council, which may be modified from time to time by amendment.
