§ 94.39 PERMIT REQUIRED TO OPEN HYDRANT.
   (A)   It shall be unlawful for any person, firm, or corporation, except duly authorized officers and employees of the city or the Campbell County Water District No. 1, to open any public fire hydrant within the city without first obtaining a permit thereof from the Chief of the Fire Department and from the Campbell County Water District.
   (B)   Any person applying for a permit to open a fire hydrant within the city shall pay to the City Clerk a sum sufficient to cover the cost of the permit, charges for pumping the hydrant, and all other charges caused by the opening of the fire hydrant, and shall comply with and be bound by the following rules and regulations.
      (1)   The person applying for a period shall first obtain from the Campbell County Water District No. 1 a permit to use water from its mains.
      (2)   The applicant shall pay to the City Clerk $5 for issuing the permit and in addition thereto a sum sufficient to cover the charge for pumping the hydrant, which is fixed at $5 for each time it is deemed necessary to pump the hydrant as determined by the Chief of the Fire Department. A separate permit must be obtained for each hydrant opened.
      (3)   The holder of the permit must notify the Fire Department of the time of starting the use of water, and of the time water use is finished each day that the hydrant is opened.
      (4)   Hydrants shall be pumped at least once each day after having been opened during the cold weather months, from November 1 through April 1 of each year.
      (5)   The holder of the permit shall be held liable for any damage to the hydrant resulting from the holder's use thereof. This liability shall be limited to the actual charges for necessary repairs as determined by the Campbell County Water District No. 1.
