§ 53.14 BILLING.
   (A)   Registration. Each residence owner shall ensure that at least one owner of the residence has registered for garbage collection services with the utility billing clerk. The owner(s) of record must be the same owner(s) of record for sewer works service.
   (B)   Hold harmless. By registering for garbage collection services, each residence owner thereby holds the town harmless from any loss, including all penalties, fines, fees, attorney's fees, interest, and court costs, or other loss if any, for suspension of garbage collection services pursuant to a violation of this chapter.
   (C)   Billing. The utility billing clerk shall send out a monthly bill for garbage collection services to each residence; provided, however, that in the case of a covered residence that is not connected to municipal water, the utility billing clerk may opt to send the bill on a quarterly basis.
   (D)   Duty to pay. Each residence owner shall timely pay, or ensure that another person has timely paid, the respective bill for garbage collection services. Each owner is jointly and severally liable for its payment.
   (E)   Private contracts. Where this chapter conflicts with the terms of a contract entered into by the Town Council, the terms of the contract control with respect to the parties, any residence that is the subject of the contract, and, as justice may require, to any other person at the residence. If an act would be a violation under this chapter but is specifically permitted in a contract entered into with the Town Council, the act is instead not a violation.
