§ 53.12 FEE PROVISIONS.
   (A)   Findings. The Town Council finds that just and equitable garbage collection services fees are those fees that provide sufficient revenue to pay all expenses incident to the operation of administering a third-party garbage collection service including, but not limited to, legal expenses, equipment, transportation, town government garbage collection service, bookkeeping, auditing, environmental and aesthetic maintenance, and customer relations. The Town Council further finds that the fees established in this chapter are just and equitable, as described herein.
   (B)   Service fee. The utility billing clerk shall assess a service fee for garbage collection services in the amount provided in § 53.13 of this chapter ("Fee Amounts") to defray the cost charged to the town by the contractor pursuant to a prior competitive bidding process.
   (C)   Administration fee. The utility billing clerk shall assess an administration fee in the amount provided in § 53.13 of this chapter ("Fee Amounts") to help cover the administration costs relating to garbage collection services.
   (D)   Late payment fee. The utility billing clerk shall assess a late payment fee equal to 10% of the combined service fee and administration fee on any utility bill that remains unpaid 30 days after having become due.
   (E)   Collection charges. The utility billing clerk shall assess collection charges, including attorney and paralegal fees, to the utility bill, if necessary, to ensure prompt payment.
   (F)   Costs. The utility billing clerk shall assess any garbage collection service costs, such as for replacement containers or additional services, that have been incurred by the town to the respective owner regarding whom the cost is properly attributable.
   (G)   Taxes. The utility billing clerk shall assess any taxes for the above fees and costs that are required to be imposed by law.
