§ 130.03 ENFORCEMENT.
   (A)   In the enforcement of this chapter, no person under 17 years of age who is apprehended for a violation of § 130.01 hereof shall be confined in any jail or other place of detention except as may be necessary to restrain or detain that person until the parent, guardian or other legal custodian can be notified and the physical custody of the person under 17 years of age can be returned to the parent or parents, guardian or other legal custodian.
   (B)   A law enforcement officer may not detain a child or take a child into custody based on a violation of this section unless the law enforcement officer, after making a reasonable determination and considering the facts and surrounding circumstances, reasonably believes that:
      (1)   The child has violated this section; and
      (2)   The child was not engaged in activities that constitute an exception under § 130.01(C).
