§ 130.01 GENERAL CURFEWS FOR MINORS.
   (A)   Curfews; local option: It is a curfew violation for a child 15, 16 or 17 years of age to be in a public place:
      (1)   Between 12:00 a.m. and 5:00 a.m. on Friday and Saturday;
      (2)   After 9:00 p.m. on Sunday, Monday, Tuesday, Wednesday or Thursday; from October 1 to April 1 and after 10:00 p.m. on Sunday, Monday, Tuesday, Wednesday or Thursday from April 1 to October 1; or
      (3)   Before 5:00 a.m. on Monday, Tuesday, Wednesday, Thursday or Friday.
   (B)   It is a curfew violation for a child under 15 years of age to be in a public place after 9:00 p.m. on any day.
   (C)   This section does not apply to child who is:
      (1)   Accompanied by his or her parent, guardian or custodian;
      (2)   Accompanied by an adult, specified by his or her parent, guardian or custodian; or
      (3)   Participating in, going to or returning from:
         (a)   Lawful employment;
         (b)   Any other organized community sponsored events such as baseball league or other organized sporting event and activities such as 4-H fair which would have similar supervision and sponsorship as a school sponsored event;
         (c)   Any other activity that is:
            1.   Organized or sponsored; and
            2.   Supervised by a responsible group, entity, town or organization; including, but not limited to, religious events, school events and political or civic events.
         (d)   An emergency errand directed by his or her parents or guardian or other adult person having the care and custody of the minor; or
         (e)   Exercising First Amendment rights protected by the United States Constitution, including the free exercise of religion, freedom of speech and right of assembly.
