§ 94.05 REGULATION OF TREE CARE.
   (A)   It shall be unlawful for any person to prevent, delay or interfere with the Board, or any of its agents, while engaging in and about the planting, cultivating, mulching, pruning, spraying or removing of any street trees or trees on private grounds, as authorized in this chapter.
   (B)   It shall be unlawful for any person or firm to engage professionally in the business or occupation of pruning, treating or removing street trees within the Town of Fremont without first filing evidence of possession of liability insurance with the Clerk-Treasurer in the minimum amounts of $50,000 for bodily injury and $100,000 for property damage indemnifying the town or any person injured or damages resulting from the pruning, treating or removing of street trees.
   (C)   Any town employee doing work in accordance with instructions of his or her supervisor, the Town Manager or the Town Council shall be exempt from these regulations but will comply with tree care regulations of this chapter as standard operating procedure.
   (D)   Any public service company, or company doing work for a public service company, doing work in the pursuit of their public service endeavors shall present a plan for pruning, trimming or removal of street trees to the town forester or his or her designee for approval before beginning work and file evidence of the plan being approved by a trained arborist.
   (E)   The Town Council shall review the conduct, acts and decisions of the Board, and any person may appeal any ruling or order of the Board to the Town Council who may hear the matter and make the final decision.
