§ 94.99 PENALTY.
   (A)   Any person who violates any section of this chapter shall be given written notice of the violation by the Town Forester or his or her designee and shall be instructed to remedy the violation within 30 days of notice.
   (B)   Any person who shall fail to remedy or abate the violation shall be fined a sum not less than $50 and not to exceed $500 for each violation, plus court costs.
   (C)   The town may commence an action to abate or enjoin the violations and/or to assess the fines in any court with appropriate jurisdiction in the county.
   (D)   In the event a lawsuit is commenced to abate the violations or to assess a fine against a person and the person is found to have failed to remedy a violation, the person shall be responsible and liable to the town for all costs of that action, including but not limited to the costs and expenses of remedying the violation, the costs of suit, expenses and reasonable attorney fees incurred by the town in bringing the action.
