§ 93.08 SALE OF ABANDONED VEHICLES.
   (A)   The owner of an abandoned vehicle shall have 20 days, from the date of the notice referenced in § 93.06, to pay the towing fee and accrued storage fees for the vehicle and to recover possession of the vehicles taken into custody by the town.
   (B)   If the owner of an abandoned vehicle does not pay the towing fees, storage fees, and recover possession of the abandoned vehicle within the 20 days provided in division (A), the town may sell the vehicle in any commercially reasonable manner, and the owner of the vehicle shall be responsible for any and all costs incurred by the town in selling the abandoned vehicle.
   (C)   (1)   Upon selling the abandoned vehicle, the town will apply the proceeds from the sale of the abandoned vehicle to the fees it incurred to tow and store the vehicle, as well as any other costs and expenses associated with selling the vehicle.
      (2)   A statement of the sale proceeds shall be sent to the owner of the abandoned vehicle that describes the application of said proceeds to fees, costs and other expenses.
      (3)   If the proceeds of the sale of the abandoned vehicle do not adequately compensate the town, then the town may sue the owner of the abandoned vehicle to obtain the remainder of the outstanding fees.
      (4)   If the proceeds from the sale exceed the costs, fees, and expenses, the town shall forward any remaining proceeds to the previous owner of the vehicle or lienholder.
