§ 71.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   Any person or persons violating any of the provisions of § 71.02, upon conviction thereof, shall be fined for the first offense the sum of $5, second offense $20 and third offense $50. Each violation constituting a separate offense.

   (C)   (1)   Any person who shall violate any of the provisions of § 71.04 shall be fined in a sum not to exceed $300.

      (2)   Anyone violating any provisions of the maximum speed limits established by § 71.04 shall be guilty of a Class C Infraction.

   (D)   (1)   Any individual operating a skateboard or other wheeling or sliding device in violation of any of the provisions contained in § 71.05 shall be subject to a fine of $50 per violation.
      (2)   In addition to the fine, any person found in violation of any provision of § 71.05 may have the skateboard or other wheeling or sliding device confiscated immediately by the Fremont Police Department or by any officer of the Fremont Police Department acting in his or her official capacity in order to abate the nuisance.
      (3)   The skateboard or wheeling or sliding device confiscated shall be held for a maximum of 90 days after which it may be sold or destroyed.
      (4)   The individual who owns any confiscated skateboard or wheeling or sliding device shall have the right to repossess the skateboard or wheeling or sliding device upon proof of payment of any fine and other costs for which the individual is responsible as a result of having violated the provisions set forth in § 71.05.
      (5)   Any individual violator of this section who is under the age of 18 years of age must disclose to the police officer or other enforcing authority the names, addresses and phone numbers of their parents or legal guardian.
