§ 51.046 SERVICE MAY BE DISCONTINUED UNDER CERTAIN CONDITIONS.
   (A)   The town may discontinue utility service upon one or more of the following conditions:
      (1)   Non-payment of a delinquent invoice for utility service 25 days after the month’s invoice is computed and mailed;
      (2)   If the property or residence receiving utility service is not in compliance with the town code after reasonable efforts by town staff to enforce compliance have failed;
      (3)   To prevent fraud or abuse;
      (4)   Where there is evidence of tampering with a meter or other town utility equipment;
      (5)   Disregard of town rules regarding water service;
      (6)   Emergency repairs;
      (7)   Insufficient supply of water caused by factors outside the town’s control;
      (8)   Legal process;
      (9)   Direction of public authorities; and/or
      (10)   Local emergency requiring emergency measures.
   (B)   Any discontinuance appeal shall be handled pursuant to § 50.34.
