§ 130.33 REGULATION OF DUMPING AT THE TOWN BURN PILE.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ALLOWABLE MATERIALS. The following are allowable materials as defined by the town for purposes of this section.
         (a)   Tree branches;
         (b)   Limbs;
         (c)   Stumps;
         (d)   Grass clippings;
         (e)   Leaves;
         (f)   Brush, bushes.
      BURN PILE. A designated location within town limits where tree limbs, yard clippings, leaves, weeds, or other natural wood products or untreated milled wood products can be dumped.
      NON-RESIDENT. Any person(s) not residing within town limits.
      RESIDENT.
         (a)   Any person(s) residing within town limits.
         (b)   Any person(s) owning or leasing property within town limits.
      UNLAWFUL MATERIALS. Trash and debris, including but not limited to: paper, plastic, cardboard, treated lumber, construction trash, drywall, wood paneling, pallets, rocks, dirt, manure, mattresses, couches, chairs, metal, wire, and wood furniture.
   (B)   Any resident may dump any of the allowable materials at the designated burn pile.
   (C)   It is unlawful for any non-resident to dump any allowable materials at the burn pile unless at least one of the following requirements have been met.
      (1)   They have obtained in advance an annual permit from the town office (annual permit fee is $200).
      (2)   They have paid a single load fee of $10 to the town office in advance in person or online, and show proof of payment.
   (D)   It is unlawful for any resident or non-resident to dump any unlawful materials at the burn pile at any time.
   (E)   Any violation of any provision of this section is designated as a petty offense. For petty offense penalties, see § 130.99.
