For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALLEY. A passage or way, dedicated to public use, affording generally a secondary means of vehicular access to abutting lots and not intended for general traffic circulation.
BLOCK. A parcel of land bounded by streets, waterways or unsubdivided acreage or a combination thereof.
DESIGN. Street alignment, grades and widths, structural design, alignment and widths of easements and rights-of-way for utilities, drainage and sanitary sewers and the arrangement and orientation of blocks and lots.
IMPROVEMENT. Required installations, pursuant to this chapter, including grading, sewer and water utilities, streets, easements and traffic control devices as a condition to the approval and acceptance of the final plat thereof.
LOT. A portion of a subdivision intended to be transferred or developed as a single unit.
LOT, DOUBLE FRONTAGE. A lot with street frontage along two opposing boundaries.
LOT, KEY. The first lot to the rear of a corner lot, the front line of which is an approximate continuation of the side line of the corner lot.
LOT, REVERSE FRONTAGE. A double frontage lot for which the boundary along one of the streets is established as the lot front and the boundary along the other street is established as the lot rear, and over the rear of which is an easement as provided in § 152.072. The rear of the lot shall be that side abutting a traffic artery or other disadvantageous use.
PLAT. A map of a subdivision.
(1) FINAL PLAT. A map of all or part of a subdivision essentially conforming to an approved preliminary plat, prepared in accordance with the provisions of this chapter, those of any applicable local ordinance and other state statutes.
(2) PRELIMINARY PLAT. A preliminary map, including supporting data, indicating a proposed subdivision design prepared in accordance with the provisions of this chapter and those of any local applicable ordinance.
(3) RECORDED PLAT. A final plat bearing all of the certificates of approval required by this chapter, any applicable local ordinance and other state statutes.
RIGHT-OF-WAY. Any public or private right-of-way and includes any area required for public use pursuant to any general or specific plan.
STREET. Any existing or proposed street, avenue, boulevard, road, lane, parkway, place, bridge, viaduct or easement for public vehicular access or a street shown in a plat heretofore approved pursuant to law or a street in a plat duly filed and recorded in the County Recorder’s office. A STREET includes all land within the street right-of-way whether improved or unimproved, and includes such improvements as pavement, shoulders, curbs, gutters, sidewalks, parking space, bridges and viaducts.
STREET LOOP. A minor street of limited length which generally follows a “U” alignment with both legs intercepting the same street.
STREET, MAJOR. A street which primarily serves to provide access along or through a subdivision or unsubdivided area for the purpose of accommodating the general traffic circulation of the community.
STREET, MINOR. A street, usually of limited continuity, which primarily serves to provide the principal means of access to abutting properties only.
SUBDIVIDER. A person, firm, corporation, partnership, association, syndicate, trust or other legal entity that undertakes the subdivision, division or resubdivision of a lot, block or other parcel of land.
SUBDIVISION.
(1) Improved or unimproved land or lands divided for the purpose of financing, sale or lease, whether immediate or future, into four or more lots, tracts or parcels of land, or, if a new street is involved, any property which is divided into two or more lots, tracts or parcels of land, or any property, the boundaries of which have been fixed by a recorded plat, which is divided into more than two parts. SUBDIVISION also includes any condominium, cooperative, community apartment, townhouse or similar project containing four or more parcels, in which an undivided interest in the land is coupled with the right of exclusive occupancy of any unit located thereon, but plats of the projects need not show the buildings or the manner in which the building or airspace above the property shown on the plat are to be divided.
(2) SUBDIVISION does not include the following:
(a) The sale or exchange of parcels of land to or between adjoining property owners if the sale or exchange does not create additional lots;
(b) The partitioning of land in accordance with other statutes regulating the partitioning of land held in common ownership; or
(c) The leasing of apartments, offices, stores or similar space within a building or trailer park, nor to mineral, oil or gas leases.
TOWN GENERAL PLAN. The comprehensive plan of the town as adopted by the Council with any amendments or revisions.
