(A) Road dedication. When platting a parcel of land which has been included on a preliminary plan and designated as a private or public street, the road right-of-way shall be platted through the final plat process simultaneously with the platting of the lots that abut that portion of the street. The plat shall comply with the requirements in §§ 1-16-89 - 1-16-90 and Article IV of this chapter.
(B) Road amendment plats. Whenever an existing street is to be altered so as to change the existing road right-of-way or alignment, a road amendment plat shall be filed with the Division for
review and approval. The size of the plat shall be 18 by 24 inches, including a 3-1/2 inch margin for binding along the left hand edge and ½ inch margin on all other sides, and shall contain the following information:
(1) A reference to the open/close/alter petition approved by the county, with approval date, ordinance number, and any conditions of approval shall be noted, if applicable.
(2) Area tabulations documenting the changes to the right-of-way and abutting properties.
(3) The title block shall appear in the lower right hand corner of the plat and shall include the following information:
(a) Name of the project and name of the road(s).
(b) Scale and date of completion. The scale shall be no smaller than 1 inch equals 100 feet;
(c) Location by election district, (both name and number), county and state.
(4) Approval blocks in the form required by the Division shall be provided in the lower left hand corner of the plat for signature by the Director.
(5) The approximate location, dimensions and area of all property proposed to be dedicated or reserved for public use, and the location, dimensions and purposes of any proposed easements, including drainage easements.
(6) The bearings and the lengths of all arcs, radii, tangents, chords and distances.
(7) Vicinity map indicating the location of the property with respect to surrounding property and streets. The scale shall be no smaller than 1 inch equals 2,000 feet. The tax map, page and parcel number, and north arrow shall be shown.
(8) The names of the owners of, and the liber and folio references for all adjoining property. If a recorded subdivision adjoins the land to be developed, the subdivision name, lot number(s) and recording reference(s) shall be indicated. (Lot lines shall be indicated with dashed lines.)
(9) The plat shall contain a north arrow and a statement indicating the origin and method of determination of the bearings or coordinate system. The plat shall also include one of the following: (1) a reference to true north, as determined by astronomic observation, (2) a reference to the Maryland Coordinate System with the controlling stations and a combination factor comprised of an elevation factor and a scale factor noted, (3) a reference to a local coordinate system with the controlling stations listed, (4) a reference to the record bearing of a well-established line found monumented on the ground, as called for in a relevant deed or plat, or (5) if the above alternatives in this paragraph are not practical, a dated magnetic bearing may be used.
(10) Accurate outlines of any areas to be reserved for common use, with the purposes indicated thereon.
(11) A surveyor's certificate stating how, when, and from whom the present owner obtained the land proposed to be altered, that the plat as shown is correct, and that it complies with the Maryland Code and these regulations. Wording specified by the Division shall be utilized.
(12) A certification and dedication by the owner or owners of the property to the effect that the right-of-way as shown on the plat is made with their consent and that they desire to record the same shall be noted on the final plat. Wording specified by the Division shall be utilized.
(13) The plat shall contain the name, address and phone number of the property owner and surveyor preparing the plat.
(C) This section does not apply to actions that will result in the creation of separate parcels of land. In such cases the public taking plat process shall be followed.
