5-2-5: DAMAGES OR CONSTRUCTION:
The city roads, right of way, curbs, and sidewalks are public assets hereafter known as city assets in this section. Property owners and their agents operating within the city of Franklin will be required to protect city assets from damage. Prior to any landscaping, remodeling, repairs, or new construction activity, the Franklin building inspector or the Franklin public works department will certify the condition of the assets that may be affected by the planned activity. The city may, at its option, require persons intending to perform any landscaping, remodeling, repairs or new construction which impacts the city assets, to post an acceptable bond in an appropriate amount as determined by the city before any work begins. If damage occurs during the construction, remodeling, landscaping, repair, or other improvement activities, the owner or contractor is responsible for restoring the damaged asset to the original condition and satisfaction of the city. If the necessary repairs are not completed or, the city may, at its option, draw upon any bond so posted to have the repairs completed or have the repairs completed and then bill the owner.
