A. Any person in violation of this chapter shall first be given a written notice of violation, which shall state the nature of the violation and set forth the time period by which the violation must be abated. If the violation is not abated within the prescribed time period, the city may proceed with prosecution or a civil enforcement action.
B. Violation of this chapter is a misdemeanor, and punishable by a fine of fifty dollars ($50.00) per day of violation, with the total fine not to exceed three hundred dollars ($300.00) per year, and also by imprisonment of up to six (6) months.
C. In addition to criminal enforcement of this chapter, Franklin may elect to seek all civil and equitable remedies available at common law or under Idaho law for the enforcement of this chapter. In the event that Franklin is the prevailing party in any civil action involving enforcement of this chapter, Franklin shall be awarded its reasonable costs and attorney fees.
