A. No person shall distribute tobacco products, e-cigarettes, their components, or samples thereof to any person under eighteen (18) years of age.
B. Except as provided for under subsection E of this section, no person shall distribute tobacco products or e-cigarettes, their components or samples thereof in any manner that does not require an in person transaction in a retail store to help prevent redemption of such merchandise by a person under eighteen (18) years of age.
C. Unless more than seventy five percent (75%) of the retail store is related to the sale of ordinary tobacco products or e-cigarettes, and all minors are excluded from the establishment with prominent warnings at all doorways, no person shall distribute tobacco products or e-cigarettes, their components or samples thereof in any manner that does not require vendor assistance.
D. No person shall distribute tobacco products or e-cigarettes, their components or samples thereof through a vending machine unless the vending machine is located fully within the retail store establishment, at least ten feet (10') from all entryways and exits and all minors are excluded from the establishment with prominent warnings at all doorways.
E. No person shall engage in the delivery sale or delivery service of tobacco products or e-cigarettes, their components or samples thereof in any manner without first verifying any recipient's or purchaser's address and that such recipient or purchaser is eighteen (18) years of age or older.
F. No person shall distribute tobacco products or e-cigarettes, their components or samples thereof in any format other than the approved and original packaging by the manufacturer.
G. No person under the age of eighteen (18) shall purchase, attempt to purchase, possess, or obtain tobacco products, e-cigarettes or their components. This prohibition does not apply to activities or enforcement actions under the control of a city, state, or federal law enforcement authority. (Ord. 2015-5-13, 5-13-2015)
