A person who possesses, cultivates, or transfers without receiving remuneration to a person who is 21 years of age or older more than five ounces of marihuana, or more than 30 grams in the form of marihuana concentrate, shall be guilty of a misdemeanor, punishable by a fine of up to five hundred dollars ($500.00) and shall be subject to imprisonment if the violation was habitual, willful, and for a commercial purpose or the violation involved violence.
