(A) There is hereby established a non-reverting city user fund under the name of Infraction Deferral Program Fund, pursuant to I.C. 33-37-8-3. All fees collected by the Clerk of the Frankfort City Court under the prosecuting attorney's infraction deferral program and transferred to the City Treasurer shall be deposited in said fund.
(B) The Infraction Deferral Program Fund shall be administered by the Treasurer pursuant to I.C. 33- 37-8-3.
(C) Expenditures from said fund shall be subject to the provisions and conditions contained in I.C. 33-37-8-3 and 33-37-8-4 and to all other applicable statutes of Indiana pertaining to the appropriation and use of public funds.
(D) All monies remaining in the fund at the end of each fiscal year shall not revert to the general fund, but shall be carried forward in the Infraction Deferral Program Fund.
(E) All references herein to provisions of the Indiana Code shall be deemed to mean and refer to said provisions, including all amendments thereto and all replacements thereof.
