The Board shall have authority to enforce this agreement on behalf of any and all persons having or claiming any interest in the Trust Fund or under this agreement or the plan. In any action or proceeding affecting the Trust Fund or any property constituting part or all thereof, the Frankfort Common Council, Plan Administrator and Board of Trustees shall be the only necessary parties and any notice or process served upon the Frankfort Common Council and the Plan Administrator shall be deemed to be served upon any employee, participant, beneficiary or other person having or claiming to have an interest in the Fund or under the plan and any judgment that may be entered in such action or proceeding shall be binding and conclusive on all persons having or claiming to have any interest in the Fund or under the plan.
