For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BIO-HAZARD CONTAINER. A hard-plastic or metal container with screw-on or tightly secured lid excluding clear plastic or glass.
BULK ITEMS. Furniture, mattresses, box springs, carpets, plumbing fixtures, automobile parts, appliances including Freon-containing appliances, and any other items which are too large or heavy to fit into trash bags.
CODE ENFORCEMENT. Persons given authority by the Frankfort Board of Public Works and Safety to make inspections of ordinance violations of this code and/or state law.
CONSTRUCTION DEBRIS. Waste building materials resulting from construction, remodeling, repair and demolition operations.
CONTAINER. A receptacle of plastic, metal or fiberglass not to exceed 33 gallons in volume, nor 40 pounds in weight. The receptacle shall have a tightfitting cover in order to be insectproof, watertight and animal-proof, and so equipped with handles to be convenient for collectors to lift and empty.
CONTAMINATED SHARP. An object that meets the following conditions:
(1) Is capable of cutting or penetrating the skin; and
(2) Has been in contact with blood or body fluids.
(3) This term includes hypodermic or suture needles, syringes or other sharp objects.
CONTRACTOR. Any person or persons performing a service on a dwelling, structure or property for the owner or occupant for a fee.
FREON WASTE ITEM. An appliance or other waste item of a type which originally contained Freon or any other nonflammable gaseous or liquid fluorinated hydrocarbons used as a refrigerant disposal of which is specifically regulated by the United States Environmental Protection Agency.
GARBAGE. The animal, fruit and vegetable waste resulting from the handling, preparation, cooking and consumption of food and of waste from the handling, storage and sale of food materials.
HAZARDOUS WASTE. Waste designated as hazardous by the United States Environmental Protection Agency (USEPA) and/or the State Department of Environmental Management (IDEM).
NATURAL DEBRIS. Leaves, trees and tree limbs of large bulk, accumulating from natural processes.
OCCUPANT. Any individual living, sleeping, cooking or eating in or having possession of a dwelling unit.
OWNER. All persons, entities or organizations who are responsible for payment of taxes on the real estate as on record at the county recorder's office; or the purchaser of such real estate under a contract for conditional sale; or person in control of the property as the personal representative, trustee, receiver or guardian of the owner.
REFUSE. Discarded waste materials in a solid or semisolid state consisting of garbage, rubbish or a combination thereof.
RESIDENTIAL COMPLEX. Habitable dwellings of four units or more that fall under the Indiana Building Code, constituting a commercial structure; or four or more residential units situated on one parcel within the city.
RUBBISH. Combustible and noncombustible waste materials other than garbage such as small quantities of natural debris, concrete, glass, crockery, ashes, boxes, barrels, metals, but excluding earth and waste from building operations, yard and garden wastes, hazardous wastes, infectious wastes and tires.
TRASH BAGS. Plastic sacks not exceeding 33 gallons in capacity designed for refuse with sufficient wall strength to maintain physical integrity when lifted, securely tied at the top for collection and not to exceed 40 pounds in loaded weight.
TRASH. Garbage and rubbish.
YARD WASTE. Leaves, grass clippings, weeds, brush, limbs, branches and other organic garden debris.
