§ 34.03  UTILITY SERVICE BOARD.
   (A)   There is a Utility Service Board to perform the duties prescribed by I.C. 8-1.5-3 concerning the statutory responsibilities of operating the electric utility, water utility, and the wastewater treatment plant and collection systems of the city.
   (B)   The Board shall be composed of five members, not more than a majority of whom shall be members of the same political party. Each member appointed shall be a resident of Clinton County, Indiana, and shall also reside within the area served by any of the utility services which are under the control of the Utility Service Board. No member of the Board shall be an employee or officer of any public utility and no member shall hold any other elected public office while serving as a member of the Board. Each member shall take and subscribe an oath of office upon such member’s appointment to the Board.
   (C)   All powers and duties associated with the construction, improvement, operation, maintenance and management of the city's storm sewer system is hereby transferred to the Utility Service Board of the city; provided that all rates, fees or regulations established by the Board with regard to such storm sewers must receive approval by the Common Council.
