For the purpose of this chapter the following definition shall apply unless the context clearly indicates or requires a different meaning.
MOPED. A vehicle with two tandem wheels, or three wheels, with solid or pneumatic tires, having a steering bar or wheel, a seat, and pedals so that the vehicle is capable of being propelled by motor or human power, or by both, and when powered by an engine having a rating of no more than
l.5 brake horse power and a cylinder capacity not exceeding 50 cubic centimeters, an automatic transmission, and a maximum design speed of no more than 25 miles per hour on a flat surface.
