(A) Any person who violates any provision of this chapter shall be subject to a civil penalty of $15; $30 for any second violation committed within 30 days of any prior violation of this chapter and $50 for any third or subsequent violation committed within one year of any prior violations of this chapter. At the option of the ordinance violator, the fine for the first violation may be waived upon the offender's completion of four hours of community service, the fine for any second violation committed within 30 days of any prior violation of this chapter may be waived, at the option of the violator, upon completion of eight hours of community service.
(B) In addition, any police officer who observes a person violating any of the provisions of this chapter shall confiscate the foot-propelled vehicle of the person in violation of the provisions of this chapter and retain the same for any period not less than one day nor more than 14 days. If the confiscated foot-propelled vehicle was being used by an individual under 18 years of age, the minor must be accompanied by his parent or guardian to retrieve the foot-propelled vehicle.
