§ 70.03  TRAFFIC AND PARKING ENFORCEMENT ON PROPERTY OWNED BY COMMUNITY SCHOOLS OF FRANKFORT.
   (A)   Traffic Enforcement Agreement.
      (1)   The Traffic Enforcement Agreement entered into by Community Schools and by the Mayor of the City of Frankfort, which agreement is dated November 8, 2011, is hereby in all means approved, as shall be amended to conform to this section, and the Frankfort Police Department is authorized to enforce traffic and signage matters on property within the City of Frankfort that is owned by Community Schools.
      (2)   The Traffic Enforcement Agreement referred to in division (A)(1) above shall be recorded in the Office of the Recorder of Clinton County, Indiana, together with a copy of this section.
   (B)   Additional regulations. The additional regulations that are hereby established and are to be enforced with respect to property owned by Community Schools are as follows:
      (1)   Exceeding posted speed limit on school property. A person may not operate a motor vehicle on property owned by Community Schools of Frankfort in excess of the posted speed limit.
      (2)   Disregarding a stop sign on school property. A person who operates a motor vehicle shall stop at all intersections where stop signs are erected at entrances to through roadways on property owned by Community Schools of Frankfort.
      (3)   Disregarding a do not enter sign on school property. A person may not operate a motor vehicle on any portion of property owned by Community Schools of Frankfort that is posted with signage reading “DO NOT ENTER.”
      (4)   Passing a school bus while loading/unloading on school property. A person who operates a motor vehicle must stop for a school bus that is loading or unloading passengers while the school bus lights are activated and stop arm is extended on property owned by Community Schools of Frankfort.
      (5)   Failure to yield at through roadway on school property. A person who operates a motor vehicle on property owned by Community Schools of Frankfort must yield the right-of-way to oncoming persons or vehicles when “YIELD RIGHT-OF-WAY” is posted.
      (6)   Failure to yield to pedestrians in a crosswalk on school property. In the absence of operating traffic control signals, a person who operates a motor vehicle on property owned by Community Schools of Frankfort shall yield the right-of-way, slowing down or stopping if necessary to yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway on which the vehicle is traveling or when the pedestrian is approaching closely from the opposite half of the roadway.
      (7)   Parking in a no parking zone on school property. A person operating a motor vehicle shall not stop, stand or park such vehicle, except when necessary to avoid conflict with other traffic or to avoid conflict with law or directions of a police officer or traffic control device in any parking space marked as “NO PARKING” on Community Schools of Frankfort property.
      (8)   Parking in a handicap zone on school property. A person shall not stop, stand or park a motor vehicle, except when necessary to avoid conflict with other traffic or to avoid conflict with law or directions of a police officer or traffic control device in any parking space marked as “HANDICAP/DISABLED” on Community Schools of Frankfort property without having an authorized handicap/disabled license plate or placard.  The exceptions to this division (B)(8) are as follows:
         (1)   A person who has a temporary or permanent physical disability that requires the use of a wheel chair, a walker, braces or crutches;
         (2)   A person who has temporarily or permanently lost the use of one or both legs;
         (3)   A person having notice from a certified physician or medical officer; and
         (4)   An advanced notice that a nurse is required.
      (9)   Parking in a visitor parking zone on school property. A person shall not stop, stand or park a motor vehicle, except when necessary to avoid conflict with other traffic or avoid conflict with law or directions of a police officer or traffic control device in any parking space marked as “VISITOR” that is not visiting on official business on Community Schools of Frankfort property. No employees, staff members or students shall park in these zones.
      (10)   Parking in emergency vehicle parking zones on school property. A person shall not stop, stand or park a motor vehicle, except when necessary to avoid conflict with other traffic or avoid conflict with law or directions of a police officer or traffic control device in any parking zone marked as “EMERGENCY VEHICLES PARKING ONLY” on Community Schools of Frankfort property. These parking zones/areas are designated for emergency response vehicles only.
      (11)   Wrong way on one-way on school property. A motor vehicle shall be driven upon a roadway designated and sign posted for one-way traffic only in the direction designated on Community Schools of Frankfort property.
   (C)   The traffic and parking regulations adopted in division (B) above, shall become a part of this title of the Municipal Code of the City of Frankfort.
   (D)   Penalties for violations of such regulations shall be as provided by § 70.99 and may be paid through the city’s Ordinance Violation Bureau.
