§ 52.02  FIRE PROTECTION COSTS.
   (A)   Public fire protection.
      (1)   Within the city. 
         (a)   The costs for the production, storage, transmission, sale, delivery or furnishing of water for public fire protection purposes ("fire protection costs") shall be recovered from all customers of the utility located inside the city' corporate limits through the assessment of a monthly fire protection surcharge.  The fire protection surcharge shall be $4 per month and shall be assessed to all customers located within the city's corporate limits.  The fire protection surcharge shall be collected by and retained by the utility.
         (b)   Effective upon the date of this change in the manner of recovering fire protection coss, the city shall cease collecting fire hydrant user fees.
         (c)   Effective upon the date of this change in the manner of recovering fire protection costs, the utility shall cease billing the city for fire protection costs.  The public fire hydrant rate set forth in Ordinance 2008-02 shall no longer be charged and is repealed.  Any balance remaining in Fund 324 entitled User Fee Hydrant Fee shall be paid to the utility.
         (d)   Nothwithstanding this change in the recovery of fire protection costs, the construction of any new fire hydrants installed at the request of the city shall continue to be paid for by or on behalf of the city.
      (2)   Outside the city.  The costs for the production, storage, transmission, sale, delivery or furnishing of water for public fire protection purposes ("fire protection costs") for customers of the utility located outside the city's corporate limits shall be recovered from customers who benefit from such public fire protection by means of a monthly out-of-town fire protection surcharge.  The initial monthly out-of- town fire protection surcharge shall be $5 per month. Customers outside the corporate limits whoa re within 1,000 feet of a public fire hydrant (measured from the hydrant to the nearest point on the property line of the customer) shall be deemed to benefit from such public fire protection.

         (2)   A customer outside the city limits shall pay 125% of the calculated charges, unless the customer is governed by an agreement between the customer and the city to make payments in lieu of taxes.
