§ 51.111  CRIMINAL LIABILITY.
   (A)   Any person who intentionally or negligently violates any provision of §§ 51.006 or 51.030 through 51.101 or permit condition or who discharges wastewater which causes pollution or who violates any cease and desist order prohibition, effluent limitation, national standard of performance, pretreatment or toxicity standard shall be liable to a sum not to exceed $25,000 for each day in which the violation occurs, or to imprisonment for not more than one year, or both.  If the conviction is for a violation committed after the first conviction of the person, punishment shall be by a fine of not more than $50,000 for each day in which the violation occurs or by imprisonment for not more than two years, or both.  The Utility Service Board shall petition a court of competent jurisdiction to impose, assess, and recover such sums.
   (B)   Any person who shall continue any violation beyond the stated time limit shall, upon conviction thereof, be subject to a fine in an amount of not less than $25 nor more than $10,000.  Each day in which any such violation shall continue shall be deemed a separate offense.  Any person violating any provision of §§ 51.006 or 51.030 through 51.101, and convicted thereof shall become liable to the city for expense, loss, or damage occasioned by the city by reason of the violation.
