Discharges of wastewater in any manner in violation of §§ 51.006 or 51.030 through 51.101, or of any order issued by the Superintendent as authorized by this chapter, is hereby declared a public nuisance and shall be corrected or abated as directed by the Superintendent. Any person violating this chapter by creating a public nuisance shall be subject to the penalty provisions of this chapter found at § 51.105, and the Board may seek injunctive relief from a court of competent jurisdication, and payment of damages as provided at § 51.109.
