§ 51.024  SURCHARGE FEE FOR INCOMPATIBLE POLLUTANTS.
   (A)   A surcharge fee shall be charged any contributor who discharges incompatible pollutants into the sewerage system.  Such surcharge fee shall be determined by the pounds of such material contributed to the sewerage system over the permit or ordinance limits, whichever is most restrictive.
   (B)   The levying and paying of a surcharge fee shall not abrogate the legal requirements as described in CFR 40 or Section 10 and Section 11 of this chapter, as they may be amended.
   (C)   The surcharge fee per pound of excess material shall be 100 times the fee in effect at the time such surcharge is levied for 100 cubic feet of sewerage.
   (D)   The surcharge fee for exceeding the permit limits for two consecutive quarters shall be twice the regular surcharge fee for the particular quarter.
   (E)   The surcharge fee for exceeding the permit limits for three consecutive quarters shall be four times the regular surcharge fee for the particular quarter.
   (F)   The regular surcharge fee shall be calculated as follows:

   (G)   The quarters for which such surcharge fee will be calculated are the calendar quarters ending March 31, June 30, September 30, and December 31, respectively.
