§ 100.61  HEATING FACILITIES.
   (A)   Facilities required.
      (1)   Heating facilities shall be provided in structures as required by this section.
      (2)   Exception. Buildings or portions of buildings, including room, that otherwise comply with rules of the Commission.
   (B)   Residential buildings. Every dwelling shall be provided with heating facilities capable of maintaining a room temperature of 68 degrees Fahrenheit (18 degrees Celsius) in all habitable rooms, bathrooms and toilet rooms based on the outside design temperature required for the locality.
      (1)   Heat supply. Every owner and operator of any building who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guestroom on terms, either express or implied, to furnish heat to the occupants thereof shall supply sufficient heat during the period from September to May to maintain the room temperatures specified in this division (B) during the hours between 6:30 a.m. and 10:30 p.m. of each day and not less than 60 degrees Fahrenheit (16 degrees in Celsius) during other hours.
      (2)   Room temperature exceptions. When the outdoor temperature is below the outdoor design temperature required for the locality by the Indiana Energy Conservation Code, the owner or operator shall not be required to maintain the minimum  room temperatures, provided that the heating system is operating at full capacity, with supply valves and dampers in a full open position.
   (C)   Room temperature measurement. The required room temperatures shall be measured at a point three feet above the floor and three feet from the exterior walls.
