§ 100.37  MINIMUM STANDARDS FOR LIGHT AND VENTILATION.
   (A)   Habitable spaces. Every newly constructed habitable room shall have at least one window or skylight facing directly outdoors. If such window or skylight cannot be easily opened to adequately ventilate the room then alternative ventilation must be provided as required. Prior construction shall be covered by the code in effect at the time of construction and installation, or alteration, in accordance with the rules of the Commission.
   (B)   Bathrooms and toilet rooms. Every bathroom and water closet compartment and non-habitable room used for food preparation shall comply with the light and ventilation requirement except that no window or skylight shall be required in such rooms if they are equipped with an adequate ventilation system, or otherwise complies with the rules of the Commission.
      (1)   Air exhausted by a mechanical ventilation system from a bathroom with a dwelling unit shall be exhausted to the exterior and shall not be re-circulated to any space, including the space from which such air is withdrawn, unless permitted under the rules of the Commission.
      (2)   Air exhausted by a mechanical ventilation system from all other bathrooms or toilet rooms shall be exhausted to the exterior without re-circulation to any space, unless permitted under the rules of the Commission.
      (3)   (a)   Every common hall and stairway, other than in one-and two-family dwellings, shall be lighted at all times with at least a 60-watt standard incandescent light bulb or equivalent for each 200 square feet of floor area, provided that the spacing between lights shall not be greater than 30 feet.  Every exterior stairway shall be illuminated with a minimum of 1 foot-candle (11 lux) at floors, landings and treads.
         (b)   Exception. Buildings and structures that comply with the rules of the Commission.
      (4)   All other spaces shall be provided with natural or artificial light sufficient to permit the maintenance of sanitary conditions, and the safe occupancy of the space and utilization of the appliances, equipment and fixtures.
   (C)   Process ventilation. Unless otherwise permitted under the rules of the Commission where injurious, toxic, irritating or noxious fumes, gases, dusts or mists are generated, a local exhaust ventilation system shall be provided to remove the contaminating agent at the source. Air shall be exhausted to the exterior and not be re-circulated to any space.
   (D)   Clothes dryer exhaust. Clothes dryer venting system shall be independent of all other systems and shall be vented to the outside in accordance with manufacturer’s instructions.
