(A) Scope. The provisions of this subchapter shall govern the current minimum conditions and the responsibilities of persons for maintenance of structures, equipment and exterior property.
(B) Responsibility. Responsibilities of owners and occupants:
(1) No owner or other person shall occupy or let to another person any dwelling unless the premises are clean, sanitary and fit for human occupancy.
(2) Every owner of a dwelling containing more than one dwelling unit shall maintain in a clean and sanitary condition the shared or public area of the dwelling and premises thereof.
(3) Every occupant of a dwelling or dwelling unit shall maintain in a clean and sanitary condition the part of the dwelling and premises thereof that he or she occupies and controls.
(4) Every occupant of a dwelling or dwelling unit shall store and dispose of all his or her rubbish in a clean, sanitary and safe manner. Rubbish and trash shall be picked up in alleys where permissible.
(5) Every occupant of a dwelling or dwelling unit shall store and dispose of all his or her garbage, refuse and any other organic waste which might provide food for insects and/or rodents in a clean, sanitary and safe manner. All garbage cans and refuse containers shall be rat proof, insect proof, water tight, structurally strong with tight fitting covers or semi closures and shall be maintained at all times in a clean, sanitary condition. Plastic garbage bags may be used on regular scheduled trash pickup days provided they are set out at the required time.
(6) The owner of every occupied premise shall supply approved bulk covered containers for rubbish, and the owner of the premise shall be responsible for the removal of rubbish. Multi-family dwellings of four or more units, commercial and industrial owners must use commercial trash removal service.
(7) The total capacity of all provided garbage and/or refuse cans and bulk storage containers shall be sufficient to meet the needs of the occupants of the building.
(8) The occupants of a dwelling shall be responsible for the extermination of insects and/or rats on the premises, except whenever the infestation is caused by failure of the owner to maintain a dwelling in a rat proof or reasonable insect proof condition at which time extermination shall be the responsibility of the owner.
(9) No buildings, vehicle, structure, receptacle, yard, lot, premises or part thereof shall be construed, made, used, maintained or operated in any manner causing or producing any health or safety hazard or permitted to become a rat or mosquito harborage or to become conducive to rat or mosquito harborage.
(10) Every owner of a dwelling shall be responsible for cutting and removing all weeds on the premises except where modified by contract with a separate occupant.
(11) Every occupant of a dwelling shall keep all supplied fixtures and facilities therein in a clean, sanitary condition and shall be responsible for the exercise of reasonable care and the proper use and operation thereof.
(12) It shall be unlawful for any occupant of any dwelling unit, building, or structure of any kind whatever to vacate the premises without his or her causing to be removed therefrom and properly disposed of all garbage or rubbish or other objectionable waste of any kind.
(13) Every owner of premises shall maintain the premises in a safe and sanitary condition and shall remove therefrom and properly dispose of all garbage, rubbish and weeds.
(14) No person shall deposit or place any refuse or other hazardous materials in or adjacent to any road, street, alley or other public place unless it is in proper container for collection.
(15) No owner or occupant shall apply a lead base paint to any surface in any dwelling, dwelling unit, rooming house and/or rooming unit.
(C) Vacant structures and land. All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety and in compliance with rules of the Commission.
