§ 93.045  UNLAWFUL BURNING.
   (A)   Except as otherwise provided under the rules of the Commission or I.C. 22-11-14, it shall be unlawful for any person, firm, corporation, or entity to kindle or burn any litter, trash, rubbish, sweepings, leaves, paper, wood, or other combustible materials openly or in any container other than a heating unit properly installed for the purpose of heating a building, or to cause the storage of explosives, or blasting agents; however, this prohibition shall not apply to wholesale and retail stocks of small arms ammunition, fuse lighters, fuse igniters, and safety fuses in quantities involving less than 50 pounds of explosive material; anywhere inside the boundaries of Fire Zones 1, 2, 3, 4, 5 and 6.
   (B)   This section shall not apply to any person residing in a residential type structure in the Fire Zones, provided the residential type structure was in existence before the date of adoption of this chapter.
