Subject to the rules of the Commission, the Chief of the Fire Department shall have the authority to waive or to modify any of the provisions of the Fire Prevention Code and Life Safety Code upon an application in writing by the owner, lessee, or duly authorized agent thereof, when such modification or waiver is and provided that the spirit of the Codes shall be observed, public safety secured, and substantial justice done. A written statement of such modification or waiver, when granted or allowed, and the decision of the Chief of the Fire Department, shall thereupon be entered upon the records of the Fire Department and signed copies shall be furnished to the applicant.
