§ 113.79 BALUSTRADES; CONSTRUCTION AND REQUIREMENTS.
   (A)   The licensee, at its sole cost and expense, shall erect, construct and maintain a balustrade or an area cordoned off from general public use and access for the sole purpose of providing an area for the public to consume alcoholic liquors during the Village Fall Festival.
   (B)   All balustrades shall meet all requirements for public safety, including providing suitable ingress for Police Department, Fire Department and other public safety personnel.
   (C)   A diagram of the area and its proposed construction and location in relation to the licensed premises shall accompany the permit.
   (D)   If the balustrade is to be erected or constructed on a sidewalk or other public way, the licensee shall not damage any public property in constructing, erecting or maintaining the balustrade and shall further provide the village with an endorsement for insurance insuring the village for any and all liability which may be occasioned on the premises in an amount not less than $500,000/$1,000,000 and also execute an agreement to indemnify and hold the village harmless from all matters associated with the use of the area enclosed by the balustrade.
   (E)   If the balustrade is proposed to be constructed on a sidewalk or other public way, the area within the balustrade shall not exceed the length of the sidewalk actually abutting the licensed premises times the width of that sidewalk.
