§ 113.41 LIVE ENTERTAINMENT; UNDESIRABLE ELEMENTS OR DISORDERLY CONDUCT PROHIBITED.
   (A)   No live entertainment may be present upon any premises where alcoholic liquor is sold or offered for sale at retail with the exception that it may be permitted under Classes A-l, B-l, C, D-l, D-2, E, F, G, H I-1, I-2, I-3, M, and N provided, however, that the applicant desiring to present live entertainment at the time of the making of application hereunder for any such class of license shall disclose on the application therefore, the fact that such entertainment shall be presented, the type and nature of such entertainment and shall pay an additional fee which shall be set from time to time by the Board of Trustees.
   (B)   In the event the Liquor Commissioner shall in his sole discretion desire to permit live entertainment on such premises, he shall so indicate in writing and any such license issued shall on the face thereto indicate that “live entertainment is permitted.” In the event the Liquor Commission shall in his sole discretion deny such application for live entertainment, he shall so indicate in writing on the application and the applicant shall be so advised within a reasonable period of time.
   (C)   Notwithstanding the foregoing, live entertainment on any premises in the Frankfort Historical District shall, if permitted, be restricted to the following days and times:
      (1)   On Wednesdays and Thursdays, live entertainment will be permitted upon the premises of the licensee until 10:30 p.m. On Friday and Saturday live entertainment will be permitted until 1:00 a.m.
      (2)   On Sundays, live entertainment will be permitted upon the premises of the licensee until 8:00 p.m.
      (3)   No live entertainment will be permitted in the Frankfort Historical District on Mondays and Tuesdays; nor will live entertainment heard from outside of the premises of the licensee be permitted on Sunday evenings during presentation of Frankfort’s Concerts-on the-Green.
      (4)   Whenever live entertainment is permitted, the level of noise shall not exceed 55 decibels prior to 10:30 p.m. and 45 decibels from 10:30 p.m. until time of closing.
      (5)   All public address systems broadcasting outdoors must be turned off in conformity with the live entertainment.
