§ 98.45 OPERATION.
   It shall be unlawful for any person to drive or operate any snowmobile in the following ways:
   (1)   At a rate of speed no greater than the minimum speed required to maintain forward movement of the snowmobile, which is considered to be less than 10 m.p.h. operating a snowmobile within the village.
   (2)   At a rate of speed too fast for conditions; the fact that the speed of the snowmobile does not exceed the applicable maximum speed limit allowed does not relieve the driver from the duty to decrease speed as may be necessary to avoid colliding with any person or vehicle or object within legal requirements and the duty of all persons to use due care.
   (3)   In a careless, reckless or negligent manner.
   (4)   While under the influence of intoxicating beverages or narcotic or dangerous drugs.
   (5)   At any time without at least one lighted headlamp and one lighted taillamp on the snowmobile.
   (6)   On the tracks or right-of-way of an operating railroad.
   (7)   In any tree nursery or planting in a manner which damages or destroys growing stock, or creates a substantial risk thereto.
   (8)   On private property, within the village corporate limits or an public or private properties adjacent to the corporate boundaries of the village.
   (9)   Within 40 feet of a residential dwelling between 9:00 a.m. and 11:00 p.m. at a speed no greater than the minimum speed required to maintain forward movement of the snowmobile, which is considered to be less than 10 m.p.h.
   (10)   On the frozen waters within the village in a manner inconsistent with the Rules and Regulations of the Illinois Department of Conservation.
   (11)   To operate a snowmobile within the village when, immediately during said period of time, the accumulation of snow existing on the ground during that time is less than the depth of two inches as measured by the village and reported on cable television, Channel 10.
