(A) Basis for wastewater service charges. The wastewater service charge for the use of and for service supplied by the wastewater facilities of the village shall consist of a basic user charge for the operation and maintenance plus replacement, administration, and debt service requirements of the system. The basic user charge for all customers shall be $2.68/1,000 gallons of use as recorded by the water meter of the customers of the village wastewater system during each billing period from June 1, 2001, to April 30, 2002. The basic user charge shall be $2.82/1,000 gallons of use as recorded by the water meter of the customers of the village wastewater system during each billing period from May 1, 2002, to April 30, 2003. With the fiscal year beginning May 1, 2002, and each year thereafter, the village wastewater service charge shall be increased annually by the percentage of the most recent Illinois Tax Extension as determined by the Will County Clerk’s Office per the regulations set for in the Property Tax Extension Limitation Law, ILCS Ch. 35, Act 200, § 18-185. Furthermore, the village shall evaluate the actual costs for operation, maintenance, and debt service of the wastewater system to ensure the basic user charge is adequate to satisfy all immediate and long term capital cost obligations of the system.
(B) East Hickory Creek Service Area. In addition, a capital charge shall be charged to those users of the system located within the East Hickory Creek Service area. The East Hickory Creek Service area is defined as those areas receiving Frankfort Waterworks Services in Richton and Monee Townships; Sections 1, 2, 11, 12, and the East one half of Sections 3 and 10 in Green Garden Township; Sections 11, 12, 13, 14, 23, 24, 25, 26, 35, 36, and the east one-half of Section 10 in Frankfort Township. The physical location of the customer's water meter shall be the basis for determining if the customer is within the East Hickory Creek Hickory Creek Service area. The wastewater capital charge to the East Basin customers shall be as follows:

(C) Basic user charge and capital charge.
(1) The basic user charge and capital charge shall be based on water usage as recorded by water meters and/or sewage meters for wastes having the following normal domestic concentrations:
(a) A five day, 20° C BOD of 200 mg/l.
(b) A suspended solids (SS) content of 220 mg/l.
(2) A surcharge will be levied to all users whose waters exceed the normal domestic concentrations of BOD (200 mg/l) and SS (220 mg/l). The surcharge will be based on water usage as recorded by water meters and/or sewage meters for all wastes which exceed the 200 mg/l and 220 mg/l concentration for BOD and SS respectively. Division (C)(3) below specifies the procedure to compute a surcharge.
(3) (a) Surcharge rate. The rates of surcharges for BOD5 and SS shall be as follows:
1. Per lb. of BOD: $ .10
2. Per lb. of SS: .11
(b) Computation of surcharge. The concentration of wastes used for computing surcharges shall be established by waste sampling. Waste sampling shall be performed as often as may be deemed necessary by the village and shall be binding as a basis for surcharges.

(D) Minimum charges. In the event that customer's actual use is less than 2,000 gal. in any given billing period, the customer will be charged for 2,000 gal. of use for that period.
(E) Adequacy of the wastewater service charge. The adequacy of the wastewater service charge shall be reviewed, not less often than annually, by certified public accountants for the village in their annual audit report. The wastewater service charge shall be revised periodically to reflect a change in local capital costs and/or operation and maintenance costs including replacement costs.
