   B.   Fees For Categories Not Covered: Building permit fees for categories of construction not covered by subsection A of this section shall be determined by the Economic Development Director and verified with the applicant prior to issuance of the permit.

   D.   Penalty Fee: A penalty fee of twice the cost of the permit required for said work shall be assessed for work started without a building permit, plus the cost of the stop work order and necessary inspections.
   E.   Historic Buildings; Waiver Of Building Permit Fees: Building permit fees may be waived in whole or in part by a majority vote of the Village Board of Trustees for the restoration of existing buildings or structures identified and classified by either the Federal, State or Municipal government authority as a historic building or structure.
Nothing herein shall constitute a waiver of any other Village Code or Building Code provision requiring the complete submission of professional architectural and engineering plans and specifications and nothing herein shall be construed or interpreted as a waiver of those Village requirements concerned with public health, safety and welfare regarding any proposed construction, alteration, repair, enlargement and relocation of buildings or structures.
   F.   Security Fund:
   1.   In addition to any other fees required herein, prior to issuance of a building permit for new construction, the permittee shall establish a cash security fund in an amount as set forth in this subsection. The security fund shall be continuously maintained in accordance with this subsection at the permittee's sole cost and expense until the completion of the work authorized under the permit. The security fund shall serve as security for:
         a.   The faithful performance by the permittee of all the requirements hereof;
         b.   Any expenditure, damage, or loss incurred by the village occasioned by the permittee's failure to comply with any codes, rules, regulations, orders, permits and other directives of the village issued pursuant hereto;
         c.   Reimbursement to the village for any and all engineering fees, attorney fees or other out of pocket consultant fees paid by the village in conjunction with the permit or the work to be performed pursuant to the permit;
         d.   For purposes of Section 6-1-4 herein, new construction shall include construction of any building, building addition, or any construction activity that includes heavy machinery for grading or similar site work.
      2.   The amount of the security fund shall be a minimum of one thousand dollars ($1,000.00) and shall be roughly equal to one percent (1%) of the building commissioner's estimated cost of the improvements, unless the building commissioner determines that costs of village consultants will exceed one percent (1%) of the estimated cost of improvements, in which event the building commissioner will identify the required amount.
      3.   The village, upon fourteen (14) days' advance written notice stating the reason for, and its intention to exercise withdrawal rights under this subsection F.3., may withdraw an amount from the security fund, provided that the permittee has not reimbursed the village for such amount within the fourteen (14) day notice period. Withdrawals may be made if the permittee:
         a.   Fails to make any payment required to be made by the permittee hereunder;
         b.   Fails to pay consultant costs incurred by the village and related to the permit or work to be performed pursuant to the permit;
         c.   Fails to reimburse the village for any damages, claims, costs or expenses which the village has been compelled to pay or incur by reason of any action or nonperformance by the permittee; or
         d.   Fails to comply with any provision hereof that the village determines can be remedied by an expenditure of an amount in the security fund.
      4.   Within ten (10) days after written notice from the village that any amount has been withdrawn from the security fund, the permittee shall restore the security fund to the amount specified in subsection F.2. of this section. If the permittee fails to so replenish the security fund, then the building commissioner may suspend the building permit and order that work on the improvement cease until such time as replenishment occurs. If replenishment does not occur within ninety (90) days after written notice specified above, the building commissioner may revoke the building permit.
      5.   Upon completion of the work authorized under the permit, the permittee shall be entitled to the return of the security fund, or such portion thereof as remains on deposit, within a reasonable time after account is taken for all offsets necessary to compensate the village for failure by the permittee to comply with any provisions hereof or other applicable law, but no later than sixty (60) days after completion of the work described in the permit. In the event of any revocation of the permit, the security fund shall become the property of the village to the extent necessary to cover any reasonable costs, loss or damage incurred by the village as a result of said revocation, provided that any amounts in excess of said costs, loss or damage shall be refunded to the permittee at such times as all such costs, loss or damage have been ascertained and analyzed. No interest shall be due to permittee for funds maintained in any security fund.
      6.   The rights reserved to the village with respect to the security fund are in addition to all other rights of the village, whether reserved hereby or otherwise authorized by law, and no action, proceeding or exercise of right with respect to said security fund shall affect any other right the village may have.
