A. Any person convicted of the violation of any section of this chapter, other than subsection 4-1-1-1B of this chapter, and those sections listed in subsections B and C of this section, shall be fined not less than twenty five dollars ($25.00) nor more than seven hundred fifty dollars ($750.00). B. Any person convicted of the violation of section 4-1-1-2 of this chapter shall be fined as follows:
For violations occurring between:
6:00 A.M. to 8:00 P.M. $ 75.00
8:00 P.M. to 12:00 midnight 150.00
12:00 midnight to 6:00 A.M. 300.00
For each additional offense an additional penalty of one hundred dollars ($100.00) per occurrence. (Ord. 96-4, 2-5-1996)
C. Any person convicted of a violation of the following sections of this chapter shall be subject to incarceration in a penal institution other than a penitentiary for a period not to exceed six (6) months and/or a fine of not less than twenty five dollars ($25.00) nor more than seven hundred fifty dollars ($750.00): 4-1-1-4A, B, C, D, 4-1-2, 4-1-3-1B, 4-1-3-3, 4-1-4-1, 4-1-4-2, 4-1-6-1, 4-1-6-2, 4-1-6-3, 4-1-7.
