5.04 Departments of Public Service and Public Safety
   (A)   The Departments of Public Service and Public Safety as provided for by the General Laws of Ohio shall continue to exist under this Charter with the powers, duties, and functions as provided in this Charter and the General Laws of Ohio applicable to General Statutory Plan Cities.
   (B)   The Directors of Public Service or Safety, including a combined Director of Public Service and Safety, shall be appointed by the Mayor, subject to the approval of a majority vote of the members of the Council taken by roll call vote at a regular or special meeting of the Council. The Directors of Public Service or Safety (or a combined Director of Public Service and Safety) serves at the pleasure of the Mayor and may be removed by the Mayor without cause; furthermore the removal shall not be subject to approval by the Council.
   (C)   In the event of the temporary absence from the City or due to a temporary disability, the Mayor may act as the Director of Public Service or Public Safety (or the combined office of Service and Safety Director); or the Mayor may designate an employee in the department to serve as acting director until the Director returns to service. Once the absence exceeds thirty (30) consecutive days, the Mayor’s designation is subject to the approval of the Council by a majority vote. The designations by the Mayor shall be filed with the Clerk of Council.
