§ 130.99 PENALTY.
   (A)   Unless otherwise provided herein, any person violating any provision of this chapter shall be fined not less than $100 nor more than $750 for each offense; and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

   (B)   Any licensee who: knowingly permits a person under the age of 21 years to use or play a video gaming terminal; or fails to fully comply with the provisions of the Illinois Video Gaming Act, being 230 ILCS 40, or § 130.02, shall have all permits of the licensee suspended, terminated or revoked and shall be subject to a fine as set forth in § 10.99 of this code of ordinances. All hearings to determine whether said permit shall be suspended, terminated or revoked shall be conducted by the Village President. All appeals from any decision of the Village President shall be limited to a review of the official record of the proceedings of the Village President.

   (C)   (1)   Any person under 21 years of age violating any provision of § 130.07 shall be fined as follows:
         (a)   First offense. A certified letter of notification of violation shall be sent by the Village Police Chief to the parent or legal guardian with the following fines:
            1.   Fifty dollar fine to be paid at the Village Hall within ten days;
            2.   Option to waive the $50 fine if violator completes a tobacco awareness class within 60 days, if available; and
            3.   If fine is not paid or a tobacco awareness class scheduled within ten days of receipt of letter, the offense will be forwarded to the Village Attorney for prosecution.
         (b)   Second offense. A certified letter of notification of violation shall be sent by the Village Police Chief to the parent or legal guardian with the following fines:
            1.   Fifty dollar fine and completion of tobacco awareness class, if available;
            2.   Fine increases to $100 if a tobacco awareness class has already been completed on the first offense; and
            3.   If fines are not paid at the Village Hall and tobacco awareness class scheduled if one is available within ten days of receipt of letter, the offense will be forwarded to the Village Attorney for prosecution.
         (c)   Third offense. A certified letter of notification of the violation shall be sent by the Village Police Chief to the parent or legal guardian with the following fines: fine of not less than $100 or more than $500 and a mandatory court appearance.
      (2)   A parent or legal guardian of a minor (person under 18 years of age), shall be notified and required to appear in court whenever that minor is charged with a violation of an ordinance or state statute which requires the minor’s appearance in court. To this end, it is hereby directed that a notice shall be sent to the parent or legal guardian of the minor stating the particular violation the minor has committed, that minor must appear in court, that a parent or legal guardian must appear before the case will be tried or disposed of, that failure to appear will result in a subpoena being issued by the court to bring such parent or legal guardian into court, and that failure to obey a subpoena can result in contempt of court with a fine or imprisonment as the penalty.
