8-1-1: OBSTRUCTIONS:
No person shall construct or maintain any bay window, bridge, wire, pipe or other structure or device over any public way or other public place; or any clock or post at the curb or any clock attached outside the face of any building; or any loading platform switch track or pushcar track upon any public way or other public place; or any tunnel or vault underneath the surface of any public way or other public place; or install or maintain any wire, pipe or conduit underneath the surface of any public way or other public place without first having obtained specific authority by ordinance passed by the Board authorizing such special privilege.
   (A)   To receive authority for erection of one of the aforementioned structures written application shall be made to the Building Commissioner accompanied by plans and specifications of the structure and a good sufficient bond executed by the grantee, running to the Village, in the penal sum of ten thousand dollars ($10,000.00) with sureties to be approved by said Commissioner and conditional upon the faithful observances and performance of each condition of the permit to be issued by the Board and conditioned further to indemnify, keep and save harmless the Village against all liabilities, judgments, costs and damages and expenses which may in any way come against the Village in consequence of the granting of said permit or which may accrue against, be charged to, or recovered from the Village by reason of any act or thing done by virtue of the authority given in said permit. Said bond shall be kept in force throughout the life of said permit and rights accruing under said permit shall be cancelled whenever said bond lapses.
Upon receipt of said application together with accompanying documents the Commissioner shall examine said application and determine whether: 1) the erection of said structure will comply with the zoning and building provisions of this Code, or 2) will not at any time be reasonably capable of constituting a nuisance within the purport of the provisions of this Code. The Commissioner shall submit said application to the Board together with his findings thereon. Thereupon the Board shall examine the findings of the Commissioner and such further information as it may otherwise acquire and make its own finding of fact as to the conformity of said proposed structure with local ordinances. It shall pass an ordinance enabling erection of the structure and cause the Clerk to issue a permit thereon if it finds that the erection of the structure will conform with local ordinances. Said permit shall be conditioned upon erection of said structure in accordance with plans and specifications, payment of appropriate fees and licenses, and shall be revokable upon a subsequent finding by the Board that the proposed structure is not being built in conformity with said plans or that there has been a failure to pay proper license and permit fees.
   (B)   Annually it shall be the duty of the Commissioner of Buildings to inspect said structures and ascertain whether or not said structure remains sound and continues to be maintained in accordance with original plans and specifications and upon submission of his annual report to the Clerk finding the said structure is properly maintained in accordance thereto the Clerk, with the requisites of this Section together with license fees pertaining thereto, shall issue a license for the annual period. License fee for any year (or portion thereof) in the event the structure is erected during a calendar year, shall be as follows:
      1.   For erection of any structure protruding over any Village street, way or place (said structure shall be not less than 12 feet from the surface of the way or place): fifty cents ($0.50) for every lineal foot or portion thereof so extended.
      2.   For erection of any loading platform switch track or pushcar track upon any public way or other public place: two dollars fifty cents ($2.50) per lineal foot or portion thereof fronting on said way or place.
      3.   For erection of any post at any curb: ten dollars ($10.00).
      4.   For erection of any tunnel or vault under any public way or place (said structure shall not interfere with existing public works): ten dollars ($10.00) for each foot of its diameter.
Failure to pay license fees provided for herein shall be an offense punishable by fine.
   (C)   In case of the installation and maintenance of an overhead system for the conduct of electrical current at more than six hundred (600) volts upon the public ways and places of the Village, in addition to other requirements of this Section, said system shall be erected and maintained in accordance with the following standards:
      1.   Conductors: Where copper is used as a conducting medium, the breaking stress shall be not less than one thousand two hundred thirty seven (1,237) pounds. Vertical space between conductors shall be one foot (1') per one hundred feet (100') of span length and minimum clearances shall be twenty six inches (26") up to eleven (11) K.V., thirty eight inches (38") where between eleven (11) K.V., and thirty three (33) K.V., fifty six inches (56") where between thirty three (33) K.V. and sixty six (66) K.V., and ninety two inches (92") where above sixty six (66) K.V.
      2.   The minimum clearances between conductors and poles shall be twelve inches (12") up to eleven (11) K.V., fourteen inches (14") from thence to thirty three (33) K.V., twenty eight inches (28") from thence to sixty six (66) K.V. and forty two inches (42") where above sixty six (66) K.V. Minimum clearances between conductors and poles shall be as above stated where pin insulators are used. Where, however, suspension type insulators are used, clearances shall be as above indicated, plus seventy five one-hundredths (0.75) times the length of the suspension insulator string.
      3.   Insulators: Insulators shall be of porcelain and smoothly glazed, where either a suspension or pin type insulator is used more than one shed shall be utilized where the line is carrying more than ten thousand (10,000) volts. The total thickness of the insulator shall be one-eighth inch (1/8") per sixteen thousand five hundred (16,500) volts carried or fraction thereof.
      4.   Grounding: A ground wire shall be strung between poles and grounded in earth every quarter mile or, as an alternative thereto, each and every pole shall be separately grounded.
      5.   Poles: Poles shall be constructed in accordance with the requirements of the National Electrical Code Handbook, 3rd Edition. Terms used herein shall be in accordance with definitions in said Handbook. (1940 Code Sec. 8-5)
