3-3-3: CLASSIFICATION OF LICENSES; FEES:
There shall be the following classifications of liquor licenses, each classification being subject to an annual license fee and a limitation of hours of operation, as indicated:
Class A (limit of 2).
The holder of a Class A license shall be authorized to sell alcoholic liquor at retail for consumption on the premises where sold.
The holder of a Class A license shall not sell or offer for sale any alcoholic liquor between the hours of two o'clock (2:00) A.M. and eight o'clock (8:00) A.M. on any day except Sunday, and not between the hours of two o'clock (2:00) A.M. and nine o'clock (9:00) A.M. on Sunday. All patrons of a licensed premises shall vacate the premises, including adjacent parking lot areas, within twenty (20) minutes after the commencement of the hours during which sale of alcohol is prohibited. In addition, the holder of the Class A license shall require that all patrons shall so vacate within the time prescribed by this section.
While no alcoholic liquor shall be sold during the aforementioned prohibited times, a licensee shall be allowed twenty (20) minutes after the commencement of such a prohibited time to clean and close the licensed premises.
The annual fee for a Class A license to sell alcoholic liquor at retail for consumption on the premises shall be one thousand dollars ($1,000.00).
Class B (limit of 1).
The holder of a Class B license shall be authorized to sell at retail only beer and wine in the original package and not for consumption on the premises of sale or at tables for consumption on the premises of sale, provided such sale is accessory to another use on the premises, such as sale of gasoline, food goods or similar items.
The holder of a Class B license shall not sell or offer for sale any such alcoholic liquor, between the hours of two o'clock (2:00) A.M. and six o'clock (6:00) A.M. on any day except Sunday, and not between the hours of two o'clock (2:00) A.M. and nine o'clock (9:00) A.M. on Sunday.
The annual fee for a Class B license to sell beer and wine at retail in the original package, but not for consumption on the premises, shall be one thousand dollars ($1,000.00).
Class C (limit of 1).
The holder of a Class C license shall be authorized to sell alcoholic liquor at retail in the original package and not for consumption on the premises of sale, provided such sale is accessory to another use on the premises such as sale of food goods or similar items.
The holder of a Class C license shall not sell or offer for sale any such alcoholic liquor between the hours of two o'clock (2:00) A.M. and six o'clock (6:00) A.M. on any day except Sunday and not between the hours of two o'clock (2:00) A.M. and nine o'clock (9:00) A.M. on Sunday.
The annual fee for a Class C license to sell alcoholic liquor at retail in the original package but not for consumption on the premises shall be one thousand dollars ($1,000.00).
Class D (limit of 5).
The holder of a Class D license shall be authorized to sell both: a) alcoholic liquor at retail in the original package and not for consumption on the premises of sale, provided such sale is accessory to another use on the premises such as sale of food goods or similar items, and b) beer and wine for consumption on the premises. The sale of beer and wine for consumption on the premises is limited as follows:
   (A)   No individual shall be sold more than two (2) alcoholic beverages during the course of a visit.
   (B)   The hours of retail sale shall be from eight o'clock (8:00) A.M. to two o’clock (2:00) A.M. on any day except Sunday and between the hours of nine o’clock (9:00) A.M. and two o’clock (2:00) A.M. on Sunday.
The holder of a Class D license shall not sell or offer for sale any package liquor between the hours of two o'clock (2:00) A.M. and six o'clock (6:00) A.M. on any day except Sunday and not between the hours of two o'clock (2:00) A.M. and nine o'clock (9:00) A.M. on Sunday.
The annual fee for a Class D license to sell both: a) alcoholic liquor at retail in the original package and not for consumption on the premises of sale, provided such sale is accessory to another use on the premises such as sale of food goods or similar items, and b) beer and wine for consumption on the premises shall be one thousand dollars ($1,000.00).
