(A) Purpose: The purpose of this Chapter is to establish regulations, standards and procedures for the siting and collocation of small wireless facilities on rights-of-way within the Village's jurisdiction, or outside the rights-of-way on property zoned by the Village as commercial or industrial zoning districts, in a manner not inconsistent with the Small Wireless Facilities Deployment Act (Public Act 100-0585).
(B) Intent:
1. Except as specifically provided in this Chapter, this Chapter does not limit the applicability of the provisions of Chapter 6 of Title 8, entitled Construction of Utility Facilities in the Public Rights-of-Way, to the location and installation of small wireless facilities within the Village. If the provisions of this Chapter and the provisions of Title 8, Chapter 6, are in conflict, this Chapter applies and controls.
2. In the event that applicable federal or State laws or regulations conflict with the requirements of this Chapter, the wireless provider shall comply with the requirements of this Chapter to the maximum extent possible without violating Federal or state laws or regulations. (Ord. 18-10, 7-24-2018)
